These terms set out the agreement between you and Darling Twigs Ltd when you visit our website, place an order, or otherwise interact with us. We've kept them as clear and short as we reasonably can. Please read them before placing an order — by completing a purchase, you're confirming you accept these terms.

Nothing in these terms affects your statutory rights as a consumer. If anything in these terms conflicts with your statutory rights, your statutory rights take precedence.

Where these terms refer to "you" or "your," we mean the customer placing an order or using the website.

How the contract works

When you place an order through darlingtwigs.com, you're making an offer to buy. We accept your offer and form a binding contract only when we send you an order confirmation email — not when you complete the checkout.

If, between the order and our confirmation, we identify a problem — for example, the item is unexpectedly out of stock, a pricing error, a suspected fraud risk, or a delivery address we cannot ship to — we may decline the order and refund you in full. We'll always let you know if this happens.

Each contract is governed by the version of these terms in force at the time the order is placed.

Placing an order

To place an order, add items to your basket, follow the checkout process, and confirm payment. You'll be asked to provide your contact details, delivery address, and payment information.

Please check your order carefully before confirming. We rely on the details you provide — particularly your delivery address — to fulfil the order correctly. If you spot an error after placing your order, email us at hello@darlingtwigs.com as soon as possible and we'll do our best to correct it before production begins. Once production has started, we may not be able to change or cancel the order.

Price and payment

Prices are shown on the product pages and are inclusive of VAT where applicable. Prices may be displayed in your local currency through Shopify Markets; the actual transaction is processed in the currency shown at checkout.

We accept payment through Shopify Payments (Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay) and PayPal. Payment is taken when you complete the checkout.

We try to keep our pricing accurate, but very occasionally errors occur. If we identify a pricing error after you've placed an order — for example, an item priced significantly lower than its true price due to a typographical or system error — we may decline the order rather than fulfilling it at the incorrect price. We'll contact you, refund any payment taken, and offer you the chance to reorder at the correct price.

Delivery

Delivery details, regions we ship to, expected timings, and our handling of lost or delayed parcels are set out in our Shipping Policy, which forms part of these terms.

Right to cancel and returns

How to cancel an order or return an item, including your statutory 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 in the UK and the equivalent rights in the EU, are set out in our Returns & Refunds Policy, which forms part of these terms.

Product quality and our promise to you

All Darling Twigs items are illustrated and printed to order through our print-on-demand partners. We take care to ensure quality, but because each item is made individually, you may notice minor variations in print placement, colour, or finish between items. These variations are part of the made-to-order nature of the product and do not constitute defects.

Genuine defects, manufacturing errors, damage in transit, or items that do not match the product description are covered in full under our Returns & Refunds Policy and your statutory rights under the Consumer Rights Act 2015.

Intellectual property

All illustrations, designs, photography, written content, and other creative material on darlingtwigs.com is owned by Darling Twigs Ltd or licensed to us. This includes all original artwork shown on our products.

When you buy a Darling Twigs item, you're buying the physical item itself. You're not buying any rights to the designs, illustrations, or other intellectual property featured on it. You may not reproduce, copy, redistribute, or otherwise use our designs for any commercial purpose without our prior written permission.

Personal, non-commercial use of the items you've bought — wearing them, photographing yourself in them, sharing photos on social media — is entirely fine and welcomed. If you tag us or use a relevant hashtag, we may share your photo on our own channels with credit; if you'd prefer we didn't, please let us know.

"Darling Twigs" is the trading name and brand of Darling Twigs Ltd. Use of the name or any associated marks for commercial purposes requires our prior written consent.

Use of our website

You may use darlingtwigs.com to browse our products, place orders, contact us, and access related services. You agree not to:

     Use the site for any unlawful purpose

     Attempt to interfere with the site's security, integrity, or normal operation

     Use automated systems (scrapers, bots, etc.) to access the site, other than well-behaved search engine indexers

     Attempt to access areas of the site not intended to be publicly available

     Reproduce, distribute, or republish content from the site beyond personal, non-commercial use

We reserve the right to suspend or terminate access to the site for users who breach these terms.

Our liability

Nothing in these terms limits or excludes our liability for:

     Death or personal injury caused by our negligence

     Fraud or fraudulent misrepresentation

     Defective products under the Consumer Protection Act 1987

     Any other liability that cannot lawfully be limited or excluded under UK or EU law

Subject to those exceptions, our total liability to you in connection with any order or use of the site is limited to the price you paid for the item or items concerned. We are not liable for indirect, consequential, or special losses, or for loss of profit, opportunity, or goodwill.

We are not responsible for delays or failures caused by events outside our reasonable control, including but not limited to acts of nature, postal or courier disruption, supplier failure, public health emergencies, civil unrest, or acts of government.

If you're not satisfied with how we've handled a matter and we can't reach a resolution, UK customers can refer to the Citizens Advice Consumer Service (citizensadvice.org.uk/consumer). EU consumers can use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Changes to these terms

We may update these terms from time to time, for example to reflect changes in our practices, our products, our service providers, or the law. The date at the top of this document shows when it was last updated.

Each order is governed by the version of the terms in force when the order is placed; updates won't apply retrospectively to existing orders.

If part of these terms is unenforceable

If any part of these terms is found to be unenforceable by a court or regulator, the rest of the terms continue to apply. We may replace the unenforceable part with a similar provision that is enforceable and reflects our original intention.

Governing law and jurisdiction

These terms and any contract between you and Darling Twigs Ltd are governed by the law of England and Wales. Any dispute arising from these terms or from a contract with us will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

If you're a consumer based in another part of the United Kingdom (Scotland or Northern Ireland) or in the European Union, you have the right to bring legal proceedings in your home jurisdiction, and the consumer protection laws of your country of residence will continue to apply to the extent they're more favourable to you.
